This Terms of Use Agreement sets forth the standards of use of the Modeldaily.com Online Service for Registered Members. By using the Modeldaily.com website you (the Member), agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at Modeldaily.com website.†Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

1.  Description of Service

Modeldaily.com is providing Member with a membership account. Member must provide (1) all equipment necessary for their own Internet connection, including computer and modem and (2) provide for Memberí access to the Internet, and (3) pay any fees relate with such connection.†

2.  Disclaimer of Warranties.

The site is provided by Modeldaily.com on an as is and on an as available basis.†To the fullest extent permitted by applicable law, Modeldaily.com makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. Modeldaily.com shall have no liability for any interruptions in the use of this Website. Modeldaily.com disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement.†Some jurisdictions do not allow the exclusion of implied warranties, therefore the above-referenced exclusion is inapplicable.

3.  Limitation of Liability

MODELDAILY.COM SHALL NOT be liable for any damages whatsoever, and in particular Modeldaily.com shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to this web site or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Modeldaily.com been advised of the possibility of such damages. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS IS INAPPLICABLE.

Member agrees to indemnify and hold Modeldaily.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys fees and costs, made by any third party due to or arising out of Members use of the Service, the violation of this Agreement, or infringement by Member, or other user of the Service using Members computer, of any intellectual property or any other right of any person or entity.

5.  Members Account

All Members of the Service shall receive a password and an account.†Members are entirely responsible for any and all activities which occur under their account whether authorized or not authorized. Member agrees to notify Modeldaily.com of any unauthorized use of Members account or any other breach of security known or should be known to the Member. Members right to use the Service is personal to the Member. Member agrees not to resell or make any commercial use of the Service without the express written consent of Modeldaily.com

6.  Modifications and Interruption to Service

Modeldaily.com reserves the right to modify or discontinue the Service with or without notice to the Member. Modeldaily.com shall not be liable to Member or any third party should Modeldaily.com exercise its right to modify or discontinue the Service. Member acknowledges and accepts that Modeldaily.com does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.

7.  Third-Party Sites

Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties.†You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site.†You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites.†Your use of those third-party sites is subject to the terms of use and privacy policies of each site, and we are not responsible therein. We encourage all Members to review said privacy policies of third-parties sites.

Product specifications and other information have either been provided by the Vendors or collected from publicly available sources.†While Modeldaily.com makes every effort to ensure that the information on this website is accurate, we can make no representations or warranties as to the accuracy or reliability of any information provided on this website.

Modeldaily.com makes no warranties or representations whatsoever with regard to any product provided or offered by any Vendor, and you acknowledge that any reliance on representations and warranties provided by any Vendor shall be at your own risk.

9.  Governing Jurisdiction of the Courts New York

Our website is operated and provided in the State of New York.†As such, we are subject to the laws of the State New York, and such laws will govern this Terms of Use, without giving effect to any choice of law rules.†We make no representation that our website or other services are appropriate, legal or available for use in other locations.†Accordingly, if you choose to access our site you agree to do so subject to the internal laws of the New York state.†

10.  Compliance with Laws.

Member assumes all knowledge of applicable law and is responsible for compliance with any such laws.†Member may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.



11.  Refund Policy

Modeldaily.com users may have profiles either at a "MD Free" level (free $0.00) or may sign up for a paid membership "MD Gold". Modeldaily.com charges membership fees for each paid membership account. Paid membership fees are renewed according to the User's selected renewal options, unless deactivated by the subscribing User. Modeldaily.com will automatically charge the membership fee to the User's designated payment method and you authorize us to charge such payment method for the appropriate membership fees and amounts stated. Modeldaily.com reserves the right to increase membership fees or to institute new fees at any time, upon reasonable notice posted in advance on this Website. The act of paying fees does not exclude the member from these terms or the site's rules, which must be obeyed by all members.

Modeldaily.com does not provide refunds for any membership fees. Downgrades to a less expensive membership or cancellation of any membership will not result in any refund or credit of fees already paid. Membership fees are charged up-front and no refunds or credits will be given upon cancellation or downgrades.

During your visit and in the course of your normal use of the site, you may download or utilize material displayed on the Site for non-commercial, personal use only (provided that you also retain all copyright and other proprietary notices contained on the materials). We neither warrant nor represent that your use of materials displayed on the Site will not infringe rights of third parties not owned by us or affiliated with this Site. Neither we nor our staff will be responsible for any misleading, false or otherwise injurious information and advice communicated on the Site or for any results obtained from the use of such information or advice. Sexually Explicit Material: We don't allow content that contains nudity, graphic sex acts, or sexually explicit material. Modeldaily has a zero-tolerance policy against child pornography. If we become aware of content with child pornography, we will report it to the appropriate authorities and delete the Modeldaily Accounts of those involved with the distribution. Modeldaily has the right to remove unrelated industry images at any time. Images must pertain to the users Profile Type and be of quality photography. Modeldaily has the right to remove unprofessional photography at any time. Unprofessional photography can be categorized as blurry, grainy, noisy, dark, sexually explicit, unrelated to users profile type, low quality photography of any kind or anything that Modeldaily feels does not qualify. Modeldaily understands that users content at times may produce clothed yet sex appeal type of photography that pertains to a users professional artistic portfolio. This specific type of photography needs to be of high quality photography and professionally done. This still does not 100% qualify that content as approved and may still be judged for acceptance by Modeldaily.com. This judgement of unprofessional photography is decided by Modeldaily only. If you find your images have been removed due to this decision, you as a member have a right for appeal. Appeals need be made through the contact page.

Hate Speech: We don't allow the promotion of hatred toward groups of people based on their race or ethnic origin, religion, disability, gender, age, veteran status, or sexual orientation/gender identity.

Impersonation or Deceptive Behavior: Don't pretend to be someone else.

Personal and Confidential Information: We don't allow unauthorized publishing of people's private and confidential information, such as credit card numbers, Social Security numbers, driver's and other license numbers, or any other information that is not publicly accessible.

Intellectual Property: Don’t infringe on the intellectual property rights of others, including patent, trademark, trade secret, copyright, and other proprietary rights. We will respond to clear notices of alleged copyright infringement. Please contact us if you feel this has been violated.

Illegal Activities: Keep it legal. Don't engage in unlawful activities on this product.

Malicious Products: Don't transmit viruses, worms, defects, Trojan horses, malware, or any other items of that may harm user devices or personal data. We don't allow content that harms or interferes with the operation of the networks, servers, or other infrastructure of Modeldaily or any third-parties. Spyware, malicious scripts and password phishing scams are also prohibited on Modeldaily.

14.  Intellectual Property

You represent and warrant that: (i) you own the content posted by you on or through the Site or otherwise have the right to grant the license set forth below, and (ii) the Posting of your content does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. If at any point you feel that others may be infringing on these rights, please contact us. You may find our contact information in the section on Infringement Policy below.

When you post content to the Site, you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the content on the Site. Through the action of posting such content (images, text, video, etc) you are also granting the Site a non-exclusive worldwide license to use, copy, publicly display, publicly perform, reformat, translate such User content (in whole or in part) and distribute such content in connection with operation of the Site. This limited license does not grant Modeldaily the right to sell or otherwise distribute your Content outside of the Modeldaily.com Services without the express permission of the rights holder(s).

You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content. This Site does not assert any ownership over your User Content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content.

15.  Botnets.

Modeldaily.com retains the right, at our sole discretion, to terminate any accounts involved with botnets and related activities. If any hostnames are used as command and control points for botnets, Modeldaily.com reserves the right to direct the involved hostnames to a honeypot, loopback address, logging facility, or any other destination at our discretion.

16.  General
Modeldaily.com does not permit children under the age of 13 to become members, post home pages or we sites or online portfolios or obtain chat rooms and email accounts on our service without their parents permission. In addition, before you can become a Modeldaily.com member and/or use the Modeldaily.com Web site if you are between the ages of 13 and 17, inclusive, you must obtain permission from your parent or guardian.

17.  Contests

If you promote a contest, sweepstakes or giveaway on Modeldaily without our express, advanced approval, you do so at your risk and you assume all risk and liability; you further agree to hold Modeldaily harmless from any claim, demand or damages. Each contest authorized by Modeldaily will have its own set of rules provided by the contest maker. To take part in a Modeldaily contest, you must abide by the specific rules associated with the contest. In addition to the contest rules, Modeldaily’s site wide rules must be followed at all times. Members who take part in contests which are not sponsored by Modeldaily, do so at their own risk.

18.  Other Terms

If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent.†You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by Modeldaily.com, in our sole discretion, to a third party in the event of a merger or acquisition.†This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member.†Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
